    Provision of the website and creation of log files

    Description and scope of data processing

    Each time our website is accessed, our system automatically collects data and information from the computer system of the accessing computer. The following data is collected:

    - Information about the browser type and version used,
    - the user's operating system,
    - the user's Internet service provider,
    - IP address of the user,
    - date and time of access,
    - websites from which the user's system accesses our website, and
    - websites that are accessed by the user's system via our website.

    This data is also stored in the log files of our system. This does not include the user's IP address or other data that enables the data to be assigned to a user. This data is not stored together with other personal data of the user.

    Legal basis for data processing

    The legal basis for the temporary storage of the data is Art. 6 para. 1 lit. f DS-GVO.

    Purpose of data processing

    The temporary storage of the IP address by the system is necessary to enable delivery of the website to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session.

    The storage in log files is done to ensure the functionality of the website. In addition, we use the data to optimise the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.

    These purposes are also our legitimate interest in data processing according to Art. 6 para. 1 lit. f DS-GVO.

    Storage duration

    The data is automatically deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended.

    Possibility of objection and elimination

    The collection of data for the provision of the website and the storage of the data in log files is absolutely necessary for the operation of the website. Consequently, there is no possibility for the user to object.

    Our website does not use direct cookies. Cookies are text files that are stored in the internet browser or by the internet browser on the user's computer system.     This website also uses Google Analytics for a cross-device analysis of visitor flows (Universal Analytics), which is carried out via a user ID.

    The legal basis for the processing of the data is Art. 6 (1) lit. a DS-GVO if the user has given his or her consent.

    We use the YouTube.com platform to post our own videos and make them publicly accessible. YouTube is the service of a third party not affiliated with us, namely YouTube LLC.

    Some of the Internet pages of our website contain links or connections to the YouTube website. In general, we are not responsible for the content of linked websites. However, if you follow a link to YouTube, we would like to point out that YouTube stores the data of its users (e.g. personal information, IP address) in accordance with its own data usage guidelines and uses it for business purposes.

    We also directly embed videos stored on YouTube on some of our Internet pages. With this integration, content from the YouTube website is displayed in parts of a browser window. However, the YouTube videos are only called up by clicking on them separately. This technique is also called "framing". When you call up a (sub-)page of our website on which YouTube videos are embedded in this form, a connection is established to the YouTube servers and the content is displayed on the website by informing your browser.

    Description and scope of data processing

    If you contact us and provide us with your contact details (in particular name, e-mail address, postal address, telephone number), this may subsequently be used by us to send a (postal and/or electronic) newsletter.

    No data will be passed on to third parties in connection with the processing of data for the dispatch of newsletters. We use Mailchimp as our newsletter service.

    Mailchimp

    We use Mailchimp from The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE Suite 5000, Atlanta, GA 30308 USA (Mailchimp) to send our newsletter. This allows us to contact subscribers directly. In addition, we analyse your usage behaviour in order to optimise our offer.

    For this purpose, we pass on the following personal data to Mailchimp:

    Mailchimp is the recipient of your personal data and acts as a processor for us as far as the sending of our newsletter is concerned. The processing of the data provided under this section is neither legally nor contractually required. Without your consent and the transmission of your personal data, we cannot send out a newsletter to you.

    In addition, Mailchimp collects the following personal data using cookies and other tracking methods: Information about your terminal device (IP address, device information, operating system, browser ID, information about the application with which you read your emails and further information about hardware and internet connection. In addition, usage data is collected such as date and time, when you opened the email / campaign and browser activity (e.g. which emails / web pages were opened). Mailchimp needs this data to ensure the security and reliability of the systems, compliance with the terms of use and the prevention of misuse. This corresponds to the legitimate interest of Mailchimp (according to Art. 6 para. 1 lit. f DSGVO) and serves the execution of the contract (according to Art. 6 para. 1 lit. b DSGVO).     Mailchimp also collects information about you from other sources. In an unspecified period and scope, personal data is collected via social media and other third-party data providers. We have no control over this process.

    The legal basis for these processing operations is your consent pursuant to Art. 6 (1) lit. a DSGVO. You can revoke your consent to the processing of your personal data at any time. A corresponding link can be found in all mailings. In addition, the revocation can be made via the specified contact options. The declaration of revocation does not affect the lawfulness of the processing carried out to date.

    Your data will be processed as long as you have given your consent. Apart from that, they will be deleted after the termination of the contract between us and Mailchimp, unless legal requirements make further storage necessary.

    Mailchimp has implemented compliance measures for international data transfers. These apply to all global activities where Stripe processes personal data of individuals in the EU.     Possibility of objection and removal

    You can revoke your consent to receive the newsletter at any time and thus unsubscribe from the newsletter. For this purpose, you will find a corresponding link in each newsletter. Furthermore, you can unsubscribe from the newsletter by sending an email to info@schwarzfoundation.com.

    This also enables you to revoke your consent to the storage of the personal data collected during the registration process.

    Rights of the person concerned

    You may at any time and free of charge request information about the data we have stored about you and - insofar as the legal requirements are met - the correction, deletion and restriction of the processing of this data.

    You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Article 6(1)(e) or (f) DSGVO.

    If the personal data concerning you is processed for the purpose of direct marketing, you have the right to object at any time to the processing of the personal data concerning you for the purpose of such marketing.

    Whether and to what extent these rights exist in individual cases and which conditions apply to them is determined by the law, in particular the GDPR.

    The GDPR also grants you a right to data portability under certain circumstances. If you have given your consent under data protection law, you can revoke this at any time with effect for the future.     We may disclose your personal data to third parties acting on our behalf, such as

    our service providers and data processors who provide services to us (e.g. accounting, hosting and maintenance services, data analytics services, email messaging services, communications services, marketing, etc.); and

    Our consultants (e.g. lawyers, accountants).

    These service providers receive the personal data solely for the purpose of providing their services to us. They are contractually obliged not to use personal data for other purposes.

    Transmission to countries outside the EU

    If necessary for our purposes, we may also transfer your data to recipients outside the EU. The transfer takes place in compliance with the data protection requirements for transfers to third countries only if it is ensured that the recipient of the data guarantees an adequate level of data protection within the meaning of Chapter V of the GDPR and no other interests worthy of protection speak against the transfer of data.
